(1) Persons, organizations or government agencies who wish to construct a building of "a", "b" or "c" class mentioned in section 8 within the municipal area shall construct the building in accordance with the prevailing law. When submitting an application to the municipality for approval, the design must also be submitted with a map.
(2) Any person, organization or government agency who wants to construct a building of category "A" or "B" mentioned in Section 8 within the rural municipality area where this Act is implemented shall prepare a map and design of the building and get it approved by the Urban Development Office. But in the case of "C" category buildings, according to the prevailing law, when applying for the approval of the map, a map according to the building code must be submitted.
(3) The map and design of the building submitted in accordance with sub-section (1) or (2) must be certified by the following person:-
(a) in the case of "A" class buildings mentioned in clause 8, from the designer concerned,
(b) In case of "B" class building mentioned in Section 8, from a civil engineer or architect registered with the Nepal Engineering Council,
(c) In the case of "c" category buildings mentioned in section 8, from a person who has passed at least certificate level in civil engineering or architect from a recognized educational institution.
